The United Nations Convention on the Rights of the Child 1989 is based on national legislation and policy in relation to children and young people. All children and young people in Wales have the following rights:

  • to be treated as individuals
  • to be treated equally and not to experience any discrimination against them
  • to be respected
  • to have privacy
  • to be treated with dignity
  • to be protected from danger and harm
  • to receive support and care that meets their needs, considers their choices and keeps them safe
  • to communicate using the communication methods and language of their choice
  • to be able to obtain information about themselves.

Early years and childcare childcare worker have a responsibility to work in a way that is based on children and young people's rights.

According to the Children's Commissioner for Wales, the Principles of an Approach based on Children's Rights are:

  • Entrenching children's rights: children's rights should be central to service planning and provision.
  • Equality and no discrimination: equality means ensuring that all children have an equal opportunity to fulfil their potential.
  • Empowering children: improving children's ability as individuals, so they can better benefit from their rights and engage with, influence and hold to account the individuals and organisations that affect their lives.
  • Participation: listening to children and paying meaningful attention to their opinions.
  • Accountability: authorities should be accountable to children for decisions and actions that affect their lives.

  • Cydraddoldeb a dim camwahaniaethu: Mae cydraddoldeb yn golygu sicrhau bod pob plentyn yn cael cyfle cyfartal i gyrraedd eu llawn botensial.
  • Grymuso plant: Gwella gallu plant fel unigolion, fel eu bod yn medru manteisio’n well ar hawliau, ac ymgysylltu â’r unigolion a’r sefydliadau hynny sy’n effeithio ar eu bywydau, dylanwadu arnynt a’u galw i gyfrif.

There are 54 articles to the UNCRC. The articles listed are rights that children and young people need to ensure that they are safe, have what they need to survive and develop, and have their say on decisions affecting their lives.

Seven Core Aims

The Welsh Government has adopted seven Core Aims to work to ensure that all children and young people:

  • have a comprehensive range of education and learning opportunities

  • have access to play, leisure, sporting and cultural activities

Advocacy

Advocacy means giving children and young people a voice, ensuring that their rights are respected and their opinions and wishes are heard. Advocacy can help children and young people to express their opinion, understand their rights and solve problems with their social worker or carer. Advocacy is essential for children or young people who are in local authority care or have communication difficulties.

An advocate is a person who represents the viewpoint of the child or young person. Advocates explain children and young people's opinions and needs and help people to make decisions. An advocate can also support children and their families/carers to make a complaint or express concern about a service.

Advocacy supports a rights-based approach as it gives children and young people a voice, as is specified in Article 12 of the United Nations Convention on the Rights of the Child "Your right to say what should happen and for someone to listen".

Eiriolaeth yw rhoi llais i blant a phobl ifanc, gan wneud yn siŵr bod eu hawliau’n cael eu parchu a bod eu barn a’u dymuniadau yn cael eu clywed. How children and their families/carers can be supported to make a complaint or express a concern about a service

Child in therapy

It is a requirement that all services have a complaints procedure to ensure that children, young people and their families/carers rights are supported. Complaints procedures also protect childcare worker by giving them guidance. The service's procedures for responding to a complaint are set out in a policy, and the policy specifies the actions to take should a service receive a complaint.

Below is an example of the steps that parents/carers can take if they want to complain, and the steps taken by the service.

  1. Contact the Leader, Manager or Registered Person of the service to make a verbal complaint. The service shall attempt to resolve the issue and inform the parents/carers of the steps taken within three working days.
  2. If it isn't possible to resolve the issue, or if the parents/carers wish to submit the complaint in writing, the matter should be formally referred in writing. The service shall conduct a full investigation and the complainant shall receive a full response within 10 working days.
  3. If the investigation is not completed within 10 working days, the service shall issue an interim report to the complainant, with an explanation regarding why additional time is needed.
  4. The service shall complete the investigation and issue a written report within 28 days.
  5. The service shall keep any correspondence, notes and reports on the case and make them available to Care Inspectorate Wales to access.

  3. Os nad yw’r ymchwiliad wedi ei gwblhau o fewn 10 diwrnod gwaith, bydd y gwasanaeth yn cyflwyno adroddiad dros dro i’r person a gwynodd, gydag esboniad ynglŷn â pam mae angen amser ychwanegol.
  4. Bydd y gwasanaeth yn cwblhau’r ymchwiliad a chyflwyno adroddiad ysgrifenedig o fewn 28 diwrnod.
