The United Nations Convention on the Rights of the Child lists the rights of all children and young people.
There are 54 articles to the UNCRC. The articles listed are rights that children and young people need to ensure that they are safe, have what they need to survive and develop, and have their say on decisions affecting their lives.
The Welsh Government has adopted seven Core Aims to work to ensure that all children and young people:
The Equality Act 2010 protects people from discrimination. It specifies the different ways in which it's illegal to treat someone. It protects individuals from unfair treatment and promotes a fairer and more equal society.
The act changes how people's needs are assessed and how services are provided. It gives people more of a say on what kind of care and support they receive.
Mae’r Confensiwn y Cenhedloedd Unedig ar Hawliau’r Plentyn yn rhestru hawliau sydd gan bob plentyn a pherson ifanc.
Mae gan y CCUHP 54 erthygl ynddo. Mae’r hawliau ar y rhestr yn bethau y mae plant a phobl ifanc angen i wneud yn siŵr eu bod yn ddiogel, bod ganddynt y pethau y mae arnynt eu hangen i oroesi a datblygu, a’u bod yn cael dweud eu dweud ar benderfyniadau sy’n effeithio ar eu bywydau.
Mae Llywodraeth Cymru wedi mabwysiadu saith Nod Craidd ar gyfer gweithio i sicrhau bod pob plentyn a pherson ifanc:
Mae Deddf Cydraddoldeb 2010 yn amddiffyn pobl rhag gwahaniaethu. Mae'n nodi'r gwahanol ffyrdd y mae'n anghyfreithlon trin rhywun. Mae’n diogelu unigolion rhag triniaeth annheg ac yn hybu cymdeithas decach a mwy cyfartal.
Mae'r ddeddf yn newid y ffordd y mae anghenion pobl yn cael eu hasesu a'r ffordd y mae gwasanaethau yn cael eu darparu. Mae'n rhoi mwy o lais i bobl am y math o ofal a chymorth y byddant yn eu cael.

Advocacy means giving children and young people a voice, ensuring that their rights are respected and their opinions and wishes are heard. Advocacy can help children and young people to express their opinion, understand their rights and solve problems with their social worker or carer. Advocacy is essential for children or young people who are in local authority care or have communication difficulties.
An advocate is a person who represents the viewpoint of the child or young person. Advocates explain children and young people's opinions and needs and help people to make decisions. An advocate can also support children and their families/carers to make a complaint or express concern about a service.
Advocacy supports a rights-based approach as it gives children and young people a voice, as is specified in Article 12 of the United Nations Convention on the Rights of the Child "Your right to say what should happen and for someone to listen".
Eiriolaeth yw rhoi llais i blant a phobl ifanc, gan wneud yn siŵr bod eu hawliau’n cael eu parchu a bod eu barn a’u dymuniadau yn cael eu clywed. Gall eiriolaeth helpu plant a phobl ifanc i fynegi eu barn, deall eu hawliau a datrys problemau gyda’u gweithiwr cymdeithasol neu ofalwr. Mae eiriolaeth yn hanfodol i blant neu bobl ifanc sydd yng ngofal yr awdurdod lleol neu sydd ag anawsterau cyfathrebu.
Eiriolwr yw person sy'n cynrychioli safbwynt y plentyn neu'r person ifanc. Mae eiriolwyr yn esbonio barn ac anghenion plant a phobl ifanc ac yn helpu pobl i wneud penderfyniadau. Gall eiriolwr hefyd gefnogi plant a’u teuluoedd/gofalwyr i wneud cwyn neu fynegi pryder am wasanaeth.
Mae eiriolaeth yn cefnogi dull gweithredu sy’n seiliedig ar hawliau gan ei fod yn rhoi llais i blant a phobl ifanc, fel mae Erthygl 12 o’r Confensiwn y Cenhedloedd Unedig ar Hawliau’r Plentyn yn nodi “Eich hawl i ddweud beth ddylai ddigwydd ac i rywun wrando arnoch”.

It is a requirement that all services have a complaints procedure to ensure that children, young people and their families/carers rights are supported. Complaints procedures also protect childcare worker by giving them guidance. The service's procedures for responding to a complaint are set out in a policy, and the policy specifies the actions to take should a service receive a complaint.
Below is an example of the steps that parents/carers can take if they want to complain, and the steps taken by the service.
Mae’n ofynnol i bob gwasanaeth cael gweithdrefn gwyno er mwyn sicrhau bod hawliau plant, pobl ifanc a’u teuluoedd/gofalwyr yn cael eu cefnogi. Mae gweithdrefnau cwyno hefyd yn amddiffyn gweithwyr gofal plant drwy roi arweinyddiaeth iddynt. Mae gweithdrefnau’r gwasanaeth ar gyfer ymateb i gŵyn yn cael ei nodi mewn polisi, ac mae’r polisi yn nodi’r camau i gymryd os yw gwasanaeth yn derbyn cwyn.
Gwelwch isod enghraifft o’r camau gall rhieni/gofalwyr neu ofalwyr gymryd os ydynt am wneud cwyn, a’r camau a gymerwyd gan y gwasanaeth.
